Washington Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy (“Policy”) provides information regarding how Body Contour Centers, LLC and our subsidiaries and affiliates (collectively, “Sono Bello”, “we,” “us,” or “our”) may collect, use, and disclose consumer health data subject to Washington law when you visit Sono Bello websites and use our services (the “Site”). This Policy applies to Washington residents and those whose consumer health data is collected in Washington. “Consumer health data,” as referenced in this Policy, means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status, under the Washington State My Health My Data Act (MHMDA). This Policy supplements Sono Bello’s Privacy Policy.

Consumer health data does not include Protected Health Information, as that term is defined under HIPAA, or health care information collected, used, or disclosed in accordance with chapter 70.02 RCW. For more information about our privacy practices relating to our provision of healthcare services, please review any Notice of Privacy Practices provided to you. If there are any inconsistencies between the Notice of Privacy Practices and this Policy, the Notice of Privacy Practices will control.

1. Consumer Health Data We Collect.

We collect Washington consumer health data in connection with our services and the type of data collected depends on your specific interaction with us. Examples include:

  • Individual health conditions, treatment, diseases, or diagnosis;
  • Social, psychological, behavioral, and medical interventions;
  • Health-related surgeries or procedures;
  • Use or purchase of prescribed medication;
  • Bodily functions, vital signs, symptoms, or measurements of the information described in this subsection;
  • Diagnoses or diagnostic testing, treatment, or medication;
  • Reproductive or sexual health information;
  • Precise location information that could reasonably indicate a consumer’s attempt to acquire or receive health services or supplies;
  • Data that identifies a consumer seeking health care services; and
  • Other information that may be processed to derive or infer data related to the above or other consumer health data.
    The categories of consumer health data above may include the following personal information, when collected in connection with your past, present, or future physical or mental health status:
  • Identifiers such as name, contact information, online identifiers, and government-issued ID numbers
  • Characteristics of protected classifications under state or federal law such as age and medical conditions;
  • Commercial information such as transaction information and purchase history;
  • Internet or network activity information such as browsing history, interactions with our website, Internet Protocol (IP) address, Media Access Control (MAC) address; operating system and version; Internet browser type and version;
  • Geolocation data such as device location; and
  • Audio, electronic, visual and similar Information such as call and video recordings.


2. Sources of Consumer Health Data

We collect personal information, which may include consumer health data, from the following categories of sources:

  • Directly from you when you use our services or interact with us.
  • From websites and mobile applications and automatically from devices you use to connect to our services.
  • From other third party or public sources

The sources of personal information depend on your specific interaction with us.

3. Use of Your Consumer Health Data

Generally, we may collect and utilize consumer health data for one or more of the following purposes:

  • To provide you with information about the services or products you have requested or authorized;
  • For analytics and improvement to better understand how you access and use the services and to evaluate and improve our services and business operations and for internal quality control;
  • To personalize your website experience and deliver content and product and service offerings relevant to your interests;
  • To ensure the secure and reliable operation of the services and the systems that support them, including troubleshooting, preventing fraud, and detecting and preventing security incidents;
  • To comply with the law and our legal obligations, and to respond to legal process and related to legal proceedings;
  • To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions, such as financings, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions; and
  • For other purposes with your consent.


4. Sharing Consumer Health Data with Third Parties

As necessary for the purposes described above, we may share personal information, including consumer health data, with the following categories of third parties

  • Subsidiaries, Affiliates and/or Related Companies. These include: Body Sculpt Intl LLC; Aesthetic Physicians, P.C.; Aesthetic Physicians of California, Inc.; Aesthetic Physicians of Colorado, P.C.; Aesthetic Physicians of Kansas Professional Association; Sono Bello Aesthetic Physicians, P.C.; and Aesthetic Physicians of Massachusetts PC.
  • Service Providers. Vendors or agents working on our behalf may access consumer health data for the purposes described above.
  • Business Transaction Participants. If we sell all or part of our business, make a sale or transfer of assets, or are otherwise involved in a corporate divestiture, merger, consolidation, acquisition, reorganization, dissolution, sale, or other disposition of all or any portion of the business or assets of, or equity interests in the business (including any affiliate), whether as part of a bankruptcy, liquidation, or similar proceeding, we may transfer your personal information, including consumer health data, to third parties as part of that transaction.
  • Government Agencies. We may disclose data to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.
  • Other Third Parties. In certain circumstances, it may be necessary to provide data to other third parties, for example, to comply with the law or to protect our rights or those of our customers.


5. How to Exercise Your Rights

MHMDA grants consumers the following rights, subject to certain exceptions:

  • Right to Know/Access. The right to request we confirm whether we are collecting, sharing, or selling your consumer health data and to access such data.
  • Right to Know Third Parties. The right to request we provide a list of all third parties and affiliates with whom we have shared or sold your consumer health data, to the extent applicable.
  • Right to Delete. Request we delete your consumer health data.
  • Withdraw Consent. To the extent we rely upon your consent for either our collection or sharing of your consumer health data, you have the right to withdraw such consent from any future collection or sharing.

Please indicate that you are making a request pursuant to your “Washington Privacy Rights” and provide us with the following information: (1) first and last name; (2) email address; (3) physical address; and (4) a detailed description of your request that allows us to properly understand, evaluate, and respond to it. We will take steps to verify your request by matching the information provided by you with the information we have in our records. If we cannot verify your identity, we may ask you for additional information to verify your identity.

If your request to exercise a right under the MHMDA is denied, you may appeal the denial. A method for submitting an appeal will be contained in our response. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

6. Changes to This Policy and Contact Information

If we make material changes to this Policy, we will inform you by posting an updated notice on this page with an updated Last Updated Date.
